The Senior Manager, Compliance will be responsible for ongoing implementation, monitoring, and maintenance of the Nestlé Health Science (NHSc) Corporate and Healthcare Compliance Programs. Position service as a collaborative strategic partner throughout the organization.

KEY RESPONSIBILITIES:

  • Implement, oversee, and monitor operations of NHSc’s Healthcare Compliance Program:
    • Advise the business on Sales and Marketing activities, customer and HCP contracts, pricing arrangements, Medical Affairs and Market Access projects, and other areas which may have healthcare compliance implications. 
  • Review new business initiatives to ensure arrangements comply with applicable laws, regulations, and the NHSc Healthcare Compliance Program.
  • Enhance NHSc’s Healthcare Compliance Program (including the Compliance Policies, Standard Operating Procedures, and compliance guidance), as needed to address new compliance risk areas arising from new products, new business initiatives, or changes or updates to applicable legal and regulatory requirements or trends.
  • Manage transparency reporting including compliance with US federal Sunshine Act and state disclosure law reports as applicable.
  • Develop and administer the compliance training program, including the development of live and web-based training content. 
  • Oversee the implementation of Healthcare Compliance requirements including working with Human Resources to ensure proper screening for applicable employees and contractors.
  • Lead the Educational and Research Grants process including creating and managing the budget and acting as Chair of the Grants Committee.
  • Develop and maintain effective communication with the business, embodying an open-door culture and overseeing a robust disclosure program including an anonymous hotline.
  • Conduct internal monitoring and auditing on an ongoing basis to assess compliance within the NHSc Healthcare Compliance Program.
  • Investigate reported or suspected violations of applicable laws, regulations or policies, and take corrective action where appropriate.
  • Monitor Patient Assistance Program, including making sure that the program is consistent with applicable laws, creating and managing the budget, and determining appropriate program guidelines.
  • Oversee NHSc’s compliance with applicable laws, rules and regulations.
    • Coordinate a compliance program to assess and addresses primary areas of compliance risk through a Corporate Compliance Committee, acting as Corporate Compliance Committee Chairperson.
    • Develop and deliver a training in corporate compliance subject areas such as ethics, fraud, bribery, and conflicts of interest.
    • Coordinate and implement compliance initiatives and training required by Nestlé Global Compliance/Legal.
    • Demonstrate commitment to the goals and core values of the company.   

EXPERIENCE AND EDUCATION REQUIREMENTS

  • BA/BS degree; advanced degree preferred (i.e., JD, MBA, Masters of Healthcare Administration).
  • 7+ years required experience in the legal, regulatory, or compliance field.
  • Experience within the healthcare product industry, preferably Medical Foods or related field (i.e., medical devices, drugs, etc.)
  • Healthcare Compliance Certificate (i.e. CHC or CHPO) is a plus.
  • Experience in developing and implementing policies and SOPs that ensure company compliance with relevant industry laws and regulations, including the False Claims Act and Anti-kickback Statute.
  • Experience with the following strongly desired:
    • Creating and leading trainings.
    • Contract construction and review.
    • Marketing/Sales literature/promotional review and approval.

The approximate pay range for this position is $128,000 – $180,000. Please note that the pay range provided is a good faith estimate for the position at the time of posting. Final compensation may vary based on factors including but not limited to knowledge, skills, and abilities as well as geographic location.
